The UK Spouse Visa allows individuals with a British partner to move to the UK and live together for up to 30 months. You must be married to, or in a civil partnership with a British Citizen, or someone settled in the UK in order to gain a UK Spouse Visa.
We are able to support those individuals looking to apply for a UK Spouse Visa along with support for any extensions and settlement applications.
The requirements for this visa are as follows:
1) UK Spouse Visa applicants will need to be supported by the following relevant documentation
2) Evidence of a genuine relationship, such as a marriage certificate
3) Bank statements and pay slips to prove that you meet the financial requirements of the visa (£18,600 per annum)
4) The minimum income threshold will increase by £3,800 for the first child and £2,400 for each additional child thereafter
5) You will need to prove you have access to accommodation within the UK, and that the applicant meets the English language requirement
The Spouse Visa can be extended after the initial 30 months, for a further 30 months. After living in the UK for 5 years, individuals can then apply for indefinite leave to remain and citizenship.
A relationship can be proven to be genuine between two partners by showing evidence of communication. This can include emails, call logs, texts, Facebook messages, photographs of you both together and any further details that may help to document your relationship.
For an additional fee, the Home Office can review your applications within 24 hours of submitting the UK Spouse Visa application to them. The Home Office fee for this service is a further £800 on top of the standard cost.
Once entry clearance application is approved for two and a half years, you can then apply for settlement, also known in the UK as Indefinite Leave to Remain. The next stage after that would be to apply for Citizenship.
This visa type allows you to live with your partner in the UK on a temporary basis.
You must apply for a Marriage Visitor visa if:
1) You want to get married or register a civil partnership in the UK.
2) You want to give notice of a marriage or civil partnership in the UK.
3) You’re not planning to stay or settle in the UK after your marriage or civil partnership.
A marriage visitor visa is for individuals who would like to marry in the UK, but are planning to leave the UK within 6 months.
Fiancé visa is for individuals who wish to marry in the UK and then remain in the UK afterwards by applying for a Spouse visa.
Fiancé visas are useful as they are one of the few visas that allow applicants to switch to a marriage category, without either the sponsor or the migrant applicant having to leave the country.
The requirements for this visa are as follows:
1) Both partners must have physically met with each other.
2) The couple intend to marry within six months of the fiancé visa being granted whilst in the UK.
3) The couple intend to live together permanently after getting married.
4) The couple must demonstrate that there is adequate accommodation for them to live in.
5) They can support themselves and dependents (if any) without recourse to public funds.
All fiancé visa applications must be made from the applicant’s home country and once they enter the UK and get married, they can then apply to stay in the country via the spouse visa route.
The UK immigration rules allow British nationals, or individuals holding Indefinite Leave to Remain (ILR), to sponsor their parents or grandparents to settle in the United Kingdom.
The requirements for this visa are as follows:
1) The dependent must be over 65 years of age
2) The dependent must be financially supported by the sponsor once they come to the United Kingdom
3) The UK sponsor must have adequate accommodation in the United Kingdom to house the dependent
4) The dependent must have no relatives in their home country who they could turn to for financial support
5) The dependent must be financially supported from the UK sponsor
Many UK visas allow the applicant to bring their family members and dependents to the United Kingdom. The UK has a number of provisions in place for children who are not British to enter and remain in the UK with their parents. There are a number of benefits in place for dependents under the age of 18 living with you in the United Kingdom.
The requirements for this visa are as follows:
1) Sole responsibility
– The child’s parents are either British or have permanent settlement status in the UK.
– Applicants will need to prove that the other parent will not have any day-to-day contact with the child and that they will not make any important, long-term decisions in relation to the child.
2) Independent life:
– The child should not be leading an independent life, they should not be financially independent and should not have their own family unit
– The parent(s) in the UK should also be able to demonstrate that they can support the child financially and accommodate them without recourse to public funds.
After 30 months of obtaining entry clearance as a spouse or civil partner, you can apply for a UK visa extension.
To be eligible for a Spouse Visa Extension, you will need to ensure that you still meet the same requirements that you met when you were granted your original Spouse Visa.
The Requirements for Visa Extension:
1) Must have a genuine subsisting relationship with your partner, (Demonstrated by specified evidence).
2) Must meet the financial requirements.
3) Be able to pass a CEFR A2 English test.
Once you are granted an extension you will maintain your residency towards indefinite leave to remain.
